style=\"color: #ff0000\">Equal Opportunities Legislation<\/span><\/h1>\n<p>Discrimination means treating people with certain characteristics differently.\u00a0 \u2018Equal opportunities\u2019 means giving all citizens an equal chance<strong> \u2013 <\/strong>eg in relation to employment opportunities, as a learner or as a consumer.<\/p>\n<h2><span style=\"color: #ff0000\">The Equality Act<\/span><\/h2>\n<p>Under the Equality Act, it is unlawful to discriminate against a person with \u2018protected characteristics\u2019 such as:<\/p>\n<ul>\n<li>Gender \u2013 eg male or female<\/li>\n<li>Marital status \u2013 eg married or single<\/li>\n<li>Age \u2013 eg youth, senior citizen<\/li>\n<li>Disability eg physical, learning need<\/li>\n<li>Race or religion.<\/li>\n<\/ul>\n<div class=\"wp-block-image\"><a href=\"https:\/\/blogs.glowscotland.org.uk\/glowblogs\/public\/n5businessmanagement\/uploads\/sites\/10132\/2023\/03\/22131311\/eq.jpg\"><img and selection;<\/li>\n<li>Dismissal or redundancy;<\/li>\n<li>Terms and conditions of employment;<\/li>\n<li>Pay and other fringe benefits;<\/li>\n<li>Promotion opportunities;<\/li>\n<li>Training opportunities.<\/li>\n<\/ul>\n<h2><span style=\"color: #ff0000\">Promoting Equal Opportunities in the Workplace<\/span><\/h2>\n<p>Apart from meeting minimum legal requirements, employers can take positive steps to promote equal opportunities by:<\/p>\n<ul>\n<li>Reorganising working conditions eg introducing flexible working practices or work place cr\u00e8ches to help employees manage a better work-life balance.<\/li>\n<li>Making reasonable adjustments to the work place eg improved disabled access or work station redesign to suit wheelchair users, provision of instructions in braille.<\/li>\n<li>Creating provision for worship at key times in the day or year eg a prayer room, and suitably timed (flexible) break times.<\/li>\n<li>Taking legal positive actions to favour groups with certain characteristics eg extra time for aptitude tests, interview quotas.<\/li>\n<li>Promoting positive attitudes eg removing the \u2018glass ceiling\u2019 which is thought to prevent career progression.<\/li>\n<\/ul>\n<h1><span style=\"color: #ff0000\"><b>Health and Safety Legislation\u00a0<\/b><\/span><\/h1>\n<div class=\"wp-block-image\"><a computer users.<\/li>\n<li>Provide necessary protective clothing eg hats and footwear on a building site.<\/li>\n<li>Provide adequate space, heating, cleanliness etc.<\/li>\n<li>Keep records of any accidents or incidents which occur.<\/li>\n<\/ul>\n<div class=\"wp-block-image\"><a safety.<\/li>\n<li>Report accidents or faulty pieces of equipment immediately.<\/li>\n<li>Cooperate with their employer to ensure the workplace is healthy and safe.<\/li>\n<\/ul>\n<h2><span style=\"color: #ff0000\"><b>Health and Safety (Display Screen Equipment) Regulations<\/b><\/span><\/h2>\n<h3><span style=\"color: #ff0000\">Employers\u2019 responsibilities include:<\/span><\/h3>\n<ul>\n<li>Ensure workstation meets minimum requirements eg footrests, brightness control.<\/li>\n<li>Offer free eye tests and glasses to computer users if required.<\/li>\n<li>Carry out annual equipment safety checks.<\/li>\n<li>Enforce breaks \u2013 5 minutes per hour.<\/li>\n<li>Provide employees with safety training.<\/li>\n<\/ul>\n<div responsibilities include:<\/span><\/h3>\n<ul>\n<li>Ensuring enough trained first aiders (one per 50-100 employees).<\/li>\n<li>First aid kits are available and correctly stocked.<\/li>\n<li>Staff are trained on first aid procedures eg who to report accidents to and emergency numbers to phone.<\/li>\n<\/ul>\n<div class=\"wp-block-image\"><a are kept clear at all times.<\/li>\n<\/ul>\n<h3><span style=\"color: #ff0000\">Impact of H&amp;S Legislation on an Organisation<\/span><\/h3>\n<ul>\n<li>Need to employ specialists to keep up to date with the law.<\/li>\n<li>Increased costs to provide necessary equipment, adaptations etc.<\/li>\n<li>Take time out of production to complete training.<\/li>\n<li>Pay fines if found to be out with the law.<\/li>\n<li>BUT good for organisation\u2019s image if employees feel looked after.<\/li>\n<\/ul>\n<h2><span style=\"color: #ff0000\"><strong>National Minimum Wage Act\/ National Living Wage<\/strong><\/span><\/h2>\n<ul>\n<li>Sets a minimum hourly rate dependent on age of worker \u2013 16-17; 18-20; 21-24; 25 and over<\/li>\n<li>Does not apply to employees on training schemes or work experience.<\/li>\n<li>25 and over is referred to as the National Living Wage.<\/li>\n<\/ul>\n<h2><span style=\"color: #ff0000\"><b>Employee<\/b><strong> Action Against Unlawful Actions By\u00a0<\/strong><b>Employers<\/b><\/span><\/h2>\n<p>An employee who feels their employment rights have been violated should approach their manager with the support of their TU rep.\u00a0 If this is not effective they may take their employer to an Employment Tribunal &#8211; this is known as taking out a grievance \u2013 if the Tribunal rules in their favour they may be entitled to instatement
