{"id":14,"date":"2023-02-24T13:20:24","date_gmt":"2023-02-24T13:20:24","guid":{"rendered":"https:\/\/blogs.glowscotland.org.uk\/fi\/equalities\/?page_id=14"},"modified":"2025-04-17T16:59:59","modified_gmt":"2025-04-17T15:59:59","slug":"legislation-and-policy","status":"publish","type":"page","link":"https:\/\/blogs.glowscotland.org.uk\/fi\/equalities\/legislation-and-national-policy-home\/legislation-and-policy\/","title":{"rendered":"Legislation"},"content":{"rendered":"<p><b>What is Equality?<\/b><\/p>\n<p>The <a href=\"https:\/\/www.equalityhumanrights.com\/en\/secondary-education-resources\/useful-information\/understanding-equality\" target=\"_blank\" rel=\"noopener\">Equality and Human Rights Commission <\/a>describes equality as:<\/p>\n<blockquote><p><em>\u2018Ensuring that every individual has an equal opportunity to make the most of their lives and talents.<br \/>\n<\/em><em>It is also the belief that no one should have poorer life chances because of the way they were born, where they come from, or whether they have a disability.\u2019<\/em><\/p><\/blockquote>\n<p><strong>The Equalities Act 2010<\/strong><\/p>\n<p>The Act legally protects people from discrimination in the workplace and in wider society, including schools. As well as protecting individuals from unfair treatment, this law also promotes a fair and more equal society. Specifically, Section 1492 of the Equality Act 2010 Act places a general duty on public authorities to have due regard to: eliminating discrimination, harassment and victimisation; advancing equality of opportunity; and fostering good relations between persons who share a<strong> protected characteristic <\/strong>and those who do not.<\/p>\n<p>The <a href=\"https:\/\/www.gov.scot\/publications\/fairer-scotland-duty-guidance-public-bodies\/\" target=\"_blank\" rel=\"noopener\">Fairer Scotland Duty<\/a> and <a href=\"https:\/\/thepromise.scot\/\">The Promise<\/a> place a legal responsibility on particular public bodies in Scotland to actively consider how they can reduce inequalities of outcome caused by socio-economic disadvantage. Socio-economic Disadvantage has therefore been included with the other nine legally <a href=\"https:\/\/blogs.glowscotland.org.uk\/fi\/equalities\/legislation-and-policy\/protected-characteristics\/\" target=\"_blank\" rel=\"noopener\">protected characteristics<\/a>.<\/p>\n<p><a href=\"https:\/\/education.gov.scot\/media\/cail41kg\/equality-and-equity-toolkit-aug21.pdf\" target=\"_blank\" 0in;text-align: left;direction: ltr\"><span style=\"font-size: 13.0pt;font-family: Calibri;color: black\">A physical or mental impairment which has a substantial and long-term adverse effect on that person's ability to carry out normal day-today activities.<\/span><\/p>\n<p>A note on <a href=\"https:\/\/www.verywellmind.com\/what-is-neurodivergence-and-what-does-it-mean-to-be-neurodivergent-5196627\">neurodivergence<\/a>: While some presentations of neurodivergence are a disability, others are not. However when reflecting on inclusivity, neurodivergence is a characteristic we should be ensuring is represented and considered.<\/p>\n\t\t\t\t<\/div>\r\n\t\t\t<\/div>\r\n\t\t\t\t\t\r\n\t\t\t\t\t\t<div class=\"hotspot-info \" id=\"hotspot-hotspot-66-2\">\r\n\t\t\t\t\r\n\t\t\t\t<h2 class=\"hotspot-title\">Gender Reassignment<\/h2>\t\t\t\t\t\t\t\t<div class=\"hotspot-content\">\r\n\t\t\t\t\t<p>Proposing to reassign gender, is undergoing a process to reassign gender, or has completed this process.<\/p>\n\t\t\t\t<\/div>\r\n\t\t\t<\/div>\r\n\t\t\t\t\t\r\n\t\t\t\t\t\t<div class=\"hotspot-info \" id=\"hotspot-hotspot-66-3\">\r\n\t\t\t\t\r\n\t\t\t\t<h2 class=\"hotspot-title\">Marriage and Civil Partnership<\/h2>\t\t\t\t\t\t\t\t<div class=\"hotspot-content\">\r\n\t\t\t\t\t<p><span style=\"font-size: 13.0pt;font-family: Calibri;color: black\">Legally married or in a civil partnership. Marriage can either be between a man and a woman, or between partners of the same sex. Civil partnership is currently between partners of the same sex (NB the law is to be changed to extend civil partnership to a woman and a man).\u00a0<\/span><\/p>\n\t\t\t\t<\/div>\r\n\t\t\t<\/div>\r\n\t\t\t\t\t\r\n\t\t\t\t\t\t<div class=\"hotspot-info \" id=\"hotspot-hotspot-66-4\">\r\n\t\t\t\t\r\n\t\t\t\t<h2 class=\"hotspot-title\">Pregnancy and Maternity<\/h2>\t\t\t\t\t\t\t\t<div class=\"hotspot-content\">\r\n\t\t\t\t\t<p style=\"line-height: 120%;margin-top: 10.0pt;margin-bottom: 0pt;margin-left: 0in;text-indent: 0in;text-align: left;direction: ltr\"><span style=\"font-size: 13.0pt;font-family: Calibri;color: black\">In a non-work situation, protection against maternity discrimination is for 26 weeks after giving birth, and this includes treating a woman unfavourably because she is breastfeeding.<\/span><\/p>\n\t\t\t\t<\/div>\r\n\t\t\t<\/div>\r\n\t\t\t\t\t\r\n\t\t\t\t\t\t<div class=\"hotspot-info \" id=\"hotspot-hotspot-66-5\">\r\n\t\t\t\t\r\n\t\t\t\t<h2 class=\"hotspot-title\">Race<\/h2>\t\t\t\t\t\t\t\t<div class=\"hotspot-content\">\r\n\t\t\t\t\t<p style=\"line-height: 120%;margin-top: 10.0pt;margin-bottom: 0pt;margin-left: 0in;text-indent: 0in;text-align: left;direction: ltr\"><span style=\"font-size: 13.0pt;font-family: Calibri;color: black\">Race, colour, nationality (including citizenship) ethnic or national origins.<\/span><\/p>\n\t\t\t\t<\/div>\r\n\t\t\t<\/div>\r\n\t\t\t\t\t\r\n\t\t\t\t\t\t<div class=\"hotspot-info \" id=\"hotspot-hotspot-66-6\">\r\n\t\t\t\t\r\n\t\t\t\t<h2 class=\"hotspot-title\">Religion or Belief<\/h2>\t\t\t\t\t\t\t\t<div class=\"hotspot-content\">\r\n\t\t\t\t\t<p><span style=\"font-size: 13.0pt;font-family: Calibri;color: black\">Religion, including a lack of religion.
