Equal Protection \u2013 information for families about changes to the law<\/u><\/em><\/strong>\u00a0<\/span><\/p>\nOn 7th November 2020 Scots law changed meaning\u00a0<\/em>that parents\/carers in Scotland can no longer use physical punishment as a reasonable form of discipling their child.\u202f Children now have the same rights as adults to be protected from any form of physical assault.\u202f\u00a0<\/span>\u00a0<\/span><\/p>\n\u00a0<\/span><\/p>\nThere are lots of different words for physical punishment including:<\/em><\/span>\u00a0<\/span><\/p>\nsmacking,\u00a0<\/em><\/span>\u00a0<\/span><\/p>\nskelping,\u00a0<\/em><\/span>\u00a0<\/span><\/p>\nhitting and\u00a0<\/em><\/span>\u00a0<\/span><\/p>\nslapping.\u00a0<\/em><\/span>\u00a0<\/span><\/p>\n\u00a0<\/span><\/p>\nThe most important things to know about why the law is changing and what it means for families are:<\/em><\/span>\u00a0<\/span><\/p>\n\u202f<\/em><\/span>\u00a0<\/span><\/p>\n\n- The change in law means that you can still stop your child from getting into danger for example grabbing them if they run into the\u00a0<\/em><\/span>road<\/em><\/span>but you won\u2019t be able to smack them afterwards.\u00a0<\/em><\/span>\u00a0<\/span><\/li>\n
- Many families in Scotland already raise their children without using physical punishment. There are lots of different ways to raise your children without physical punishment and you can still choose between these in how you manage your children\u2019s behaviour and bring them up.\u00a0<\/em>There\u2019slots of support out there for parents and carers who would like to talk about other options.\u00a0<\/span>\u00a0<\/span><\/li>\n
- Physical punishment\u00a0<\/em>doesn\u2019twork \u2013 there have been lots of studies from around the world which show that physical punishment doesn\u2019t teach children to behave differently and that it can make relationships between children and their parents\/carers worse.\u00a0<\/span>\u00a0<\/span><\/li>\n
- Physical punishment can harm children \u2013 today we know a lot more about how children\u2019s brains\u00a0<\/em><\/span>develop<\/em><\/span>and it has been repeatedly shown that physical punishment can do long term harm to children\u2019s physical and emotional health.<\/em><\/span>\u00a0<\/span><\/li>\n<\/ul>\n
Everyone<\/u><\/em><\/strong><\/span>\u00a0now has a duty to act if they\u00a0<\/em><\/span>witness, or<\/em><\/span>\u00a0are aware of a child or young person being physically chastised. This\u00a0<\/em>is now a crime and if reported as such, will be investigated by the Police just like all other crimes.\u00a0\u00a0<\/span>\u00a0<\/span><\/p>\n\u00a0<\/span><\/p>\nIf you need to talk to someone about what the change in law means for your family, or managing your children\u2019s behaviour our\u00a0<\/em><\/span>Children 1st\u00a0Parentline<\/em><\/span><\/a>\u00a0team can give you free, non-judgmental support.
